_“Emotion as an element of contemporary Criticism in the intellectual Environment of the Weimar Republic – A contextual Reading of the Presentation of the Affective in Martin Heidegger and Carl Schmitt”_ This article examines a specific use of emotional concepts as well as a particular understanding of the affective in general in the work of Heidegger and Schmitt during the years 1919-1933. The general character of this idea of the affective is that it is developed as an element of a (...) critical engagement with discourses regarding institutional change. Thus, I will be reading the two thinkers in the light of institutional disputes present in the Weimar Republic. Heidegger is read in relation to the question of university reform, with which he was deeply involved in the 1920´s. Schmitt will be analyzed through the political situation of the newly established liberal democracy. In both cases, I will argue that a conception of the affective is developed that serves to attack a perceived relativism. This is seen in the fact that, for both thinkers, certain affective categories are linked to stable existential categories: being for Heidegger and the dichotomy between friend and foe for Schmitt. Phenomenological literary criticism has long taken the one-on-one exchange with an other as the model for thinking about the reader-to-text relationship. However, new novels portraying genocides and civil wars are more likely to position readers as witnesses. Drawing on Jean-Luc Marion’s description of the subject as witness as well as works by Kelly Oliver and Jacques Derrida, this article offers a phenomenological description of the reader as witness. As witness, the reader is situated both by the literary text and also (...) by his or her particular embodied and intersubjective relations to the world. Constituted and no longer constituting, the reader/subject as witness finds herself a site in which other’s decisions have already been made, and her responsibility arises from the decisions she makes possible for others in the future. How do we inferentially unify separately acquired empirical information into a single comprehensive picture of the lives of persistent particulars? This paper argues that hidden in such inferences is a Fregean puzzle that can only be solved by individuating our demonstratives thoughts in terms of object-dependent Fregean Senses. I begin by characterizing some constraints on a non-skeptical account of our inferential unification of empirical information. I then go on to show that traditional Fregean views of Sense cannot explain the rationality (...) of such inferences; the consequence of which would be widespread skepticism concerning fundamental aspects of our empirical worldview. I show how the theory of object-dependent Senses can account for the rationality of the puzzling inferences. Lastly, I consider the alternative that we abandon a Fregean explanation of the rationality of inferences. While not fully dismissing that option, I briefly raise, what I take to be, a daunting challenge that uniquely faces non-Fregean views of rational inference. (shrink)

Beneficence is a foundational ethical principle in medicine. To provide benefit to a patient is to promote and protect the patient’s wellbeing, to promote the patient’s interests. But there are different conceptions of wellbeing, emphasizing different values. These conceptions of wellbeing are contrary to one another and give rise to dissimilar ideas of what it means to benefit a patient. This makes the concept of beneficence ambiguous: is a benefit related to the patient’s goals and wishes, or is it a (...) matter of objective criteria that constitute wellbeing? This paper suggests a unified conception of wellbeing for use in medicine to determine what counts as a benefit. Two components of wellbeing are identified: (1) objective functioning/health and (2) the patient’s view of her own good. The paper explores how to apply, balance, and weigh these components in clinical situations to determine what counts as a benefit to a patient. (shrink)

McDowell recently renounced the assumption that the content of any knowledgeable, perceptual judgement must be included in the content of the knowledge grounding experience. We argue that McDowell’s introduction of a new category of non-inferential, perceptual knowledge is incompatible with the main line of argument in favour of conceptualism as presented in Mind and World [McDowell, John. 1996. Mind and World. 2nd ed. Cambridge, MA: Harvard University Press]. We reconstruct the original line of argument and show that it rests on (...) the assumption that a specific model of justification, the Comparison Model, must apply to all cases of non-inferential, perceptual knowledge. We then show that the Comparison Model cannot be applied to McDowell’s new category of non-inferential, perceptual knowledge. As a consequence, McDowell is in need of an alternative model of justification and an alternative argument for conceptualism. We propose such an alternative model of justification based on McDowell’s reading of Sellars, but argue that the model only serves to make the need for an alternative motivation for conceptualism more urgent. In this accessible new biography, Mendes-Flohr situates Buber’s life and legacy in the intellectual and cultural life of German Jewry as well as in the broader European intellectual life of the first half of the twentieth century. Analytic social ontology has been dominated by approaches where institutions tend to come out paradigmatically as being relatively harmonious and mutually beneficial. This can however raise worries about such models potentially playing an ideological role in conceptualizing certain politically charged features of our societies as marginal phenomena or not even being institutional matters at all. This article seeks to develop a nonideal theory of institutions, which neither assumes that institutions are beneficial or oppressive, and where ideology is understood as a (...) structuring and stabilizing phenomenon that helps maintain specific distributions of rights and duties by conferring perceived legitimacy onto them. This reading goes back to the seminal work of Von Wright in the early 1960's and has returned in computer science in the 1990' s and in more abstract "dependency logics" today. We show how it differs from ceteris paribus as "all other things being normal", which is used in contexts with preference defeaters. We provide a semantic analysis and (...) several completeness theorems. We show how our system links up with Von Wright's work, and how it applies to game-theoretic solution concepts, to agenda setting in investigation, and to preference change. Starting from MacIntyre’s virtue ethics, we investigate several codes of conduct of banks to identify the type of virtues that are needed to realize their mission. Based on this analysis, we define three core virtues: honesty, due care, and accuracy. We compare and contrast these codes of conduct with the actual behavior of banks that led to the credit crisis and find that in some cases banks did not behave according to the moral standards they set themselves. However, although banks (...) and the professionals working in them can be blamed for what they did, one should also acknowledge that the institutional context of the free market economy in which they operated made it difficult to live up to the core values lying at the basis of the codes of conduct. Given the neo-liberal free market system, innovative and risky strategies to enhance profits are considered desirable for the sake of shareholder’s interests. A return to the core virtues in the financial sector will therefore only succeed if a renewed sense of responsibility in the sector is supported by institutional changes that allow banks to put their mission into practice. We investigate two under-explored factors in mitigating the risk of corporate fraud and regulatory enforcement against fraud, namely institutional investors and political connections. The role of institutional investors in the effective monitoring of a firm’s management is well established in the literature. We further observe that firms that have a large proportion of their shares held by institutional investors have a lower incidence of enforcement actions against corporate fraud. The importance of political connections for enterprises, whether in a developed market (...) such as the United States or an emerging market such as China, has been established by previous studies. However, we find evidence of another positive effect of political connections: they may reduce the incidence of enforcement action against corporate fraud. We also find that political connections play a more significant role in reducing regulatory enforcement incidents against non-state-owned enterprises and firms in weaker legal environments, whereas institutional ownership plays a more important role in reducing regulatory enforcement incidents against state-owned enterprises. A significant part of contemporary social ontology has been focused on understanding forms of collective intentionality. It is suggested in this paper that the contested nature of some institutional matters makes this kind of approach problematic, and instead an alternative approach is developed, one that is oriented towards a micro-level analysis of the institutional constraints that we face in everyday life and which can make sense of how there can be institutional facts that are deeply contested and yet still real. Human rights have increasingly been put forward as an important framework for bioethics. In this paper, it is argued that human rights offer a potentially fruitful approach to understanding the notion of Respect for Persons in bioethics. The idea that we are owed a certain kind of respect as persons is relatively common, but also quite often understood in terms of respecting people’s autonomous choices. Such accounts do however risk being too narrow, reducing some human beings to a second-class moral (...) status. This paper puts forward a political approach to our standing as persons and a strongly pluralistic account of human rights that lays the ground for a more broadly applicable conception of Respect for Persons. It is further argued that this model also provides an example of a more general approach to philosophical ethics, an approach which is here called taxonomical pluralism. Current dynamic-epistemic logics model different types of information change in multi-agent scenarios. We generalize these logics to a probabilistic setting, obtaining a calculus for multi-agent update with three natural slots: prior probability on states, occurrence probabilities in the relevant process taking place, and observation probabilities of events. To match this update mechanism, we present a complete dynamic logic of information change with a probabilistic character. The completeness proof follows a compositional methodology that applies to a much larger class of dynamic-probabilistic (...) logics as well. Finally, we discuss how our basic update rule can be parameterized for different update policies, or learning methods. (shrink)

Saul Smilansky's Illusionism suggests that some false beliefs are important enough to warrant the indefinite perpetuation of illusions in order to protect the larger moral community from breaking down. In this article I suggest that this position actualises an old educational paradox where education is expected to protect the common moral community (even if this means maintaining some illusions), and at the same time promote the pursuit of truth. Taking Smilansky's position of Illusionism as a starting point, I argue that (...) while Illusionism highlights and addresses an important problem—that sometimes false beliefs can function to maintain social stability where the truth threatens to unsettle it—relying on indefinite illusions is problematic from an educational point of view. It is difficult to justify that education, being at least in part motivated by truth-seeking, should (or even could) be grounded in illusion. Taking seriously the fact that a dimension of education concerns maintaining social stability, I suggest that Spinoza's notion of fiction can complement Smilansky's view in that it can be conceived in terms of an instrument for maintaining social stability and promoting truth-seeking without assuming that one end is pursued at the expense of the other. Classical epistemic logic describes implicit knowledge of agents about facts and knowledge of other agents based on semantic information. The latter is produced by acts of observation or communication that are described well by dynamic epistemic logics. What these logics do not describe, however, is how significant information is also produced by acts of inference—and key axioms of the system merely postulate “deductive closure”. In this paper, we take the view that all information is produced by acts, and hence we (...) also need a dynamic logic of inference steps showing what effort on the part of the agent makes a conclusion explicit knowledge. Strong omniscience properties of agents should be seen not as static idealizations, but as the result of dynamic processes that agents engage in. This raises two questions: (a) how to define suitable information states of agents and matching notions of explicit knowledge, (b) how to define natural processes over these states that generate new explicit knowledge. To this end, we use a static base from the existing awareness literature, extending it into a dynamic system that includes traditional acts of observation, but also adding and dropping formulas from the current ‘awareness’ set. We give a completeness theorem, and we show how this dynamics updates explicit knowledge. Then we extend our approach to multi-agent scenarios where awareness changes may happen privately. Finally, we mention further directions and related approaches. Our contribution can be seen as a ‘dynamification’ of existing awareness logics. (shrink)

This article argues that the translation of books may be fruitfully understood as constituting a cultural world-system. The working of this system, based on a core-periphery structure, accounts for the uneven flows of translations between language groups as well as for the varying role of translations within language groups. The final part outlines how this general sociological model may be further developed.

Corporate social responsibility (CSR) is becoming increasingly important in China. This paper investigates the implementation of instruments for dimensions of CSR that are relevant for the Chinese context and the challenges that Chinese companies face. Based on a survey among 109 Chinese companies, we find that formal instruments to implement CSR are rather common. Companies spend most effort in improving the economic aspects of CSR, such as competitiveness, product innovation and process innovation. Only a small minority of the companies set (...) concrete targets and report the realization of these targets for social and environmental goals. This indicates that the attention to social and environmental aspects of CSR is still rather loose. The most important challenges for improving CSR are strong competitive pressure, insufficient support from the government and/or nongovernmental organizations and high costs of CSR implementation. Multiple regression analysis shows that the use of instruments is positively related to company size and foreign ownership and negatively related to lack of resources and support for CSR by investors and consumers. Taking Löb's Axiom in modal provability logic as a running thread, we discuss some general methods for extending modal frame correspondences, mainly by adding fixed-point operators to modal languages as well as their correspondence languages. Our suggestions are backed up by some new results – while we also refer to relevant work by earlier authors. But our main aim is advertizing the perspective, showing how modal languages with fixed-point operators are a natural medium to work with.

In considering patriarchy as potentially institutional and as a characteristic also of contemporary Western societies, a fundamental issue concerns how to make sense of largely informal institutions to begin with. Traditional accounts of institutions have often focused on formalized ones. It is argued here, however, that the principal idea behind one commonly accepted conception of institutions can be developed in a way that better facilitates an explication of informal institutions. When applied to the phenomenon of patriarchy, such an approach can (...) then also allow us to ontologically make sense of gray areas and hierarchies of authority, as well as the intersectionality of social positions. Defensive medicine has become pervasive. Defensive medicine is often thought of as a systems issue, the inevitable result of an adversarial malpractice environment, with consequent focus on system-responses and tort reform. But defensive medicine also has ethical and professionalism implications that should be considered beyond the need for tort reform. This article examines defensive medicine from an ethics and professionalism perspective, showing how defensive medicine is deeply problematic. First, a definition of defensive medicine is offered that describes the essence of (...) defensive practice: clinical actions with the goal of protecting the clinician against litigation or some adverse outcome. Ethical arguments against defensive medicine are considered: defensive medicine is deceptive and undermines patient autonomy; defensive medicine subjugates patient interests to physician interests and violate fiduciary obligations; defensive medicine exposes patients to harm without benefit; defensive medicine undermines trust in the profession; and defensive medicine violates obligations of justice. Possible arguments in favor of defensive medicine are considered and refuted. Defensive practice is therefore unethical and unprofessional, and should be viewed as a challenge for medical ethics and professionalism. (shrink)

This paper explores the relationship between religious belief and the dilemmas Dutch executives confront in daily business practice. We find that the frequency with which dilemmas arise is directly related to various aspects of religious belief, such as the belief in a transcendental being and the intensity of religious practice. Despite this relationship, only 17% of the dilemmas examined involve a religious standard. Most dilemmas originate from a conflict between moral and practical standards. Minimal predicates P satisfying a given first-order description ϕ(P) occur widely in mathematical logic and computer science. We give an explicit first-order syntax for special first-order 'PIA conditions' ϕ(P) which quarantees unique existence of such minimal predicates. Our main technical result is a preservation theorem showing PIA-conditions to be expressively complete for all those first-order formulas that are preserved under a natural model-theoretic operation of 'predicate intersection'. Next, we show how iterated predicate minimization on PIA-conditions yields a language MIN(FO) equal (...) in expressive power to LFP(FO), first-order logic closed under smallest fixed-points for monotone operations. As a concrete illustration of these notions, we show how our sort of predicate minimization extends the usual frame correspondence theory of modal logic, leading to a proper hierarchy of modal axioms: first-order-definable, first-order fixed-point definable, and beyond. Experientialist semantics has contributed to a broader notion of linguistic meaning by emphasizing notions such as construal, perspective, metaphor, and embodiment, but has suffered from an individualist concept of meaning and has conflated experiential motivations with conventional semantics. We argue that these problems can be redressed by methods and concepts from phenomenology, on the basis of a case study of sentences of non-actual motion such as “The mountain range goes all the way from Mexico to Canada.” Through a phenomenological reanalysis (...) of proposals of Talmy, Langacker, and Matlock, we show that non-actual motion is both experientially and linguistically non-unitary. At least three different features of human consciousness—enactive perception, visual scanning, and imagination—constitute experiential motivations for non-actual motion sentences, and each of these could be related to phenomenological analyses of human intentionality. The second problem is addressed by proposing that the experiential motivations of non-actual motion sentences can be viewed as sedimented through “passive” processes of acquisition and social transmission and that this implies an interactive loop between experience and language, yielding losses in terms of original experience, but gains in terms of communal signification. Something that is underestimated by phenomenology is that what is sedimented are not only intentional objects such as states of affairs, but aspects of how they are given, i.e., the original, temporal, bodily experiences themselves. Since cognitive semantics has emphasized such aspects of meaning, we suggest that phenomenology can itself benefit from experientialist semantics, especially when it turns its focus from prepredicative to predicative, linguistic intentionality. Issues about information spring up wherever one scratches the surface of logic. Here is a case that raises delicate issues of 'factual' versus 'procedural' information, or 'statics' versus 'dynamics'. What does intuitionistic logic, perhaps the earliest source of informational and procedural thinking in contemporary logic, really tell us about information? How does its view relate to its 'cousin' epistemic logic? We discuss connections between intuitionistic models and recent protocol models for dynamic-epistemic logic, as well as more general issues that emerge.

Theoria — a Swedish journal for philosophy was founded in 1935, at a time when the conditions for the logical empiricists on the European continent were deteriorating as a result of the rise of fascism and Nazism. In a letter, dated August 11 1936, to the editor-in-chief of Theoria, Åke Petzäll, the Finnish philosopher Eino Kaila claimed that it was only a matter of time until the journal Erkenntnis would be closed down and suggested that Theoria could step in as (...) a replacement. This paper defends four lines of argument that establish an ethical obligation for clinicians to be vaccinated against COVID-19. They are: (1) The obligation to protect patients against COVID-19 spread; (2) The obligation to maintain professional competence and remain available for patients; (3) Clinicians’ role and place in society in relation to COVID-19; (4) The obligation to encourage societal vaccination uptake. These arguments stand up well against potential objections and provide a compelling case to consider acceptance of COVID-19 vaccination a (...) duty for all clinicians. This duty brings with it the implication that vaccine refusal amounts to a dereliction of the professional’s ethical obligations, which means such clinicians should be subject to disciplinary action. Furthermore, this duty provides grounding for mandatory vaccination policies for clinicians. (shrink)

This paper considers the distribution of responsibility for prevention of negative social or ecological effects of production and consumption. Responsibility is related to ability and ability depends on welfare. An increase in competition between Western companies depresses their profitability, but increases the welfare of Western consumers and,hence, their ability to acknowledge social values. Therefore, an increase in competition on consumer markets shifts the balance in responsibility from companies to consumers to prevent negative external effects from production and consumption patterns. This article begins with the question: What is it to live? It is argued that, from a Spinozistic perspective, to live is not an either/or kind of matter. Rather, it is something that inevitably comes in degrees. The idea is that through good education and proper training a person can learn to increase his or her degree of existence by acquiring more adequate ideas. This gradual qualitative enhancement of existence is an operationalization of Spinoza's quest for immortality of the mind. (...) While Spinoza's idea of immortality differs from the traditional Christian account of the immortality of the soul in some key respects, it nevertheless concerns a form of immortality of the mind albeit grasped from a strictly naturalistic standpoint. And as such it is clear that we are faced with not only a philosophical and metaphysical problem of some magnitude but that we have come up against an educational problem that is rarely addressed. The educational problem, emanating from this, concerns the tension between Spinoza's necessitarianism and the overall goal of education. Why educate people at all if their lives are already predetermined? In addressing these problems, this article marks an attempt to present a pedagogization of the degrees of existence in Spinoza. To this end, it is argued that the imitation of affects is key to understanding Spinoza in an educational setting and; that teaching, in a Spinozistic context, involves the act of offering the right amount of resistance. This article proposes a systematic application of recent developments in the logic of preference to a number of topics in deontic logic. The key junction is the well-known Hansson conditional for dyadic obligations. These conditionals are generalized by pairing them with reasoning about syntactic priority structures. The resulting two-level approach to obligations is tested first against standard scenarios of contrary-to-duty obligations, leading also to a generalization for the Kanger-Anderson reduction of deontic logic. Next, the priority framework is applied to model (...) two intuitively different sorts of deontic dynamics of obligations, based on information changes and on genuine normative events. In this two-level setting, we also offer novel takes on vexed issues such as the Chisholm paradox and modelling strong permission. Finally, the priority framework is shown to provide a unifying setting for the study of operations on norms as such, in particular, adding or deleting individual norms, and even merging whole norm systems in different manners. Social acceptance is assumed to have widespread positive effects on the recipient; however, ethnic/racial minorities often react negatively to social acceptance by White individuals. One possibility for such reactions might be their lack of trust in the genuineness of White individuals’ positive evaluations. Here, we examined the role that oxytocin—a neuropeptide putatively linked to social processes—plays in modulating reactions to acceptance or rejection during interracial interactions. Black participants received intranasal oxytocin or placebo and interacted with a White, same-sex stranger who (...) provided positive or negative social feedback. After positive feedback, participants given oxytocin tended to display approach-oriented cardiovascular responses of challenge, exhibited more cooperative behavior, and perceived the partner to have more favorable attitudes toward them after the interaction. Following negative feedback, oxytocin reduced anger suppression. Oxytocin did not modulate testosterone reactivity directly, but our exploratory analysis showed that the less participants suppressed anger during the interaction with their partner, the greater testosterone reactivity they displayed after the interaction. These results survived the correction for multiple testing with a false discovery rate of 20%, but not with a rate of 10 or 5%. Discussion centers on the interplay between oxytocin and social context in shaping interracial interactions. (shrink)
